TERMS AND CONDITIONS

THE NATURE OF THESE TERMS

This document sets out the standard booking terms and conditions of Elusive Retreats.

  1. Automatic Acceptance: Payment of the initial deposit constitutes automatic acceptance of these terms.

  2. Contractual Binding: A contract automatically arises between the Booker and TLW upon deposit receipt.

PASSPORTS AND VISAS

It is your sole responsibility to maintain valid travel documents. TLW cannot assist in obtaining passports, visas, or entry documentation. You must ensure validity for all transit stops and destinations prior to departure.

TRANSFERS

Unless clearly stated as “Included” in your specific package, transport is not included.

  • Deadlines: If transfers are included, flight details must be sent by the required deadline or the right to transfer is voided.

  • Waiting Times: To coordinate multiple flights, a waiting time of approximately two hours may be expected at the airport.

  • Third-Party Delays: TLW is not responsible for cancelled or delayed flights that affect your scheduled transfer.

  • Conduct: All guests must follow driver instructions. Consumption of alcohol or smoking on transfers is strictly prohibited and may lead to expulsion.

LUGGAGE

  • Hold Storage: Luggage is stored in the vehicle hold and is inaccessible during the journey.

  • Responsibility: Guests are responsible for loading/unloading their own bags. TLW is not liable for items left behind or damaged during loading.

  • Valuables: Keep passports, money, and electronics in hand luggage.

ACCOMMODATION & SECURITY DEPOSITS

  • Security Deposit: A lump-sum security deposit may be required upon arrival via credit/debit card. This is strictly between you and the accommodation provider.

  • Damage: Costs for damages caused by any member of a Group will be deducted from this deposit.

  • Check-In/Out: Check-in is typically after 14:00. Check-out is between 09:00 and 11:00.

  • Facilities: Use of spas, gyms, or saunas may incur extra charges not covered by TLW.

ITINERARY & THIRD-PARTY EXPERIENCES

  • Deviations: Itineraries may change due to weather, major events, or safety concerns. TLW is not liable for these deviations.

  • Third-Party Services: Experiences booked directly through local vendors (not TLW) are independent. TLW assumes no liability for loss or damage during these activities.

USE OF VEHICLES

If renting motorbikes, scooters, or cars:

  • Licensing: You must possess a valid driving license recognized in the destination.

  • Sobriety: Driving under the influence of drugs or alcohol is strictly prohibited. Passengers assume a duty of care to prevent an impaired driver from operating a vehicle.

  • Risk: Drivers operate vehicles at their own risk.

PAYMENTS & CANCELLATIONS

  • Currency: The default price is in USD ($). Payments in other currencies are subject to exchange rate fluctuations and internal TLW rates.

  • Installments: Failure to pay an installment by the due date may result in automatic cancellation without a refund.

  • Price Changes: TLW reserves the right to adjust prices due to tax changes or errors, though no changes will be made within 28 days of departure.

VARIATIONS & CHANGES

  • Changes by You: Requests to change booking details must be made in writing. A $100 administration fee applies per change.

  • Change of Customer: Substitution of a guest is permitted up to 60 days before the trip, subject to a $100 fee and written approval.

  • Unavoidable Circumstances: In cases of “Force Majeure” (natural disasters, pandemics, war), TLW follows regulatory advice which may include credit vouchers instead of cash refunds.

PHYSICAL FITNESS

You must notify TLW in writing of any medical problems or disabilities prior to booking. TLW reserves the right to decline a booking if we feel unable to properly accommodate specific medical needs for the safety of the guest.
